By accessing or using this website, you (“User”, “you”, or “your”) agree to be bound by these Terms, our Privacy Policy, and all applicable policies, notices, and guidelines. All content, data, software, tools, design elements, and materials displayed on or forming part of MyEquityLab are the exclusive intellectual property of Spark Loom Private Limited and/or its licensors, protected under applicable copyright, trademark, and intellectual property laws. Users are granted only a limited, non-exclusive, non-transferable, revocable license to access and use the website strictly in accordance with these Terms. No content may be copied, reproduced, modified, stored, transmitted, distributed, published, reverse engineered, or exploited without express written consent. Any unauthorized use constitutes infringement and may lead to legal action including injunctive relief and damages.

MyEquityLab reserves the absolute right to restrict or modify access to any part of the platform, introduce or revise fees for any service, and determine, at its sole discretion, which features are provided on a free, paid, promotional, or limited-period basis. All promotional or complimentary services are subject to withdrawal or modification without prior notice. Where legally required, MyEquityLab may conduct Know Your Customer (“KYC”) verification. Users agree to provide accurate, complete, and updated information for the purpose of registration, subscription, or KYC compliance, and shall neither impersonate any person nor permit any third party to access or use their account. MyEquityLab may accept or reject any registration request and may suspend or terminate any account containing false, misleading, outdated, or incomplete information. The Client further undertakes to provide true, correct, and complete details, including but not limited to Permanent Account Number (PAN), Aadhaar number in masked form, and valid contact information, for KYC verification through a SEBI-registered KYC Registration Agency (KRA). All KYC records shall be collected, verified, stored, and updated by the Research Analyst (“RA”) in accordance with SEBI regulations, circulars, and guidelines and in full compliance with the Digital Personal Data Protection Act, 2023, ensuring that Aadhaar data is stored and processed only in masked or redacted form. The Client agrees to promptly update any changes in personal, financial, or contact details to ensure that KYC records remain accurate at all times. MyEquityLab reserves the right to restrict, suspend, or terminate access to the platform or Services if the Client fails to provide complete KYC information or does not update such information as required under applicable law.

Users shall use the website strictly in compliance with applicable laws and must not engage in any unlawful, fraudulent, harmful, defamatory, offensive, or disruptive activities. Users shall not upload, transmit, or distribute any material containing viruses, malware, trojans, worms, or harmful code, nor attempt to breach the security, integrity, or functionality of the platform. Users shall not infringe upon the intellectual property, privacy, confidentiality, proprietary, or legal rights of MyEquityLab or any third party. Any disputes arising between Users shall be resolved solely between them, and no liability shall rest upon MyEquityLab in this regard. Users further represent full compliance with Anti-Money Laundering laws, including the Prevention of Money Laundering Act, 2002, and affirm that funds used for subscriptions are derived from lawful sources.

All payments on MyEquityLab are processed exclusively through CCAvenue, a third-party payment gateway. By initiating any transaction, the User acknowledges that CCAvenue may collect and process payment information under its own terms and policies. MyEquityLab does not store or access sensitive payment data. MyEquityLab shall not be liable for payment gateway errors, failures, delays, or unauthorized transactions. Users shall bear any charges or penalties imposed by financial institutions. All transactions are encrypted, and Users agree to comply with CCAvenue’s terms. Refunds shall be processed strictly in accordance with applicable SEBI regulations and shall only be issued in compliance with regulatory guidelines.

MyEquityLab may modify, amend, or update these Terms at any time without prior notice. The User’s continued use of the website after any modification constitutes acceptance of the revised Terms. MyEquityLab may alter, suspend, or discontinue any part of the website, including content, features, community sections, tools, or access requirements, effective immediately upon posting.

Users agree to indemnify, defend, and hold harmless MyEquityLab, Spark Loom Private Limited, and their directors, officers, employees, agents, service providers, and representatives from any claims, liabilities, damages, losses, or expenses (including legal or professional fees) arising out of or related to their use of the website, any breach of these Terms, or violation of any rights of any person or entity.

MyEquityLab disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, uninterrupted access, error-free service, or freedom from viruses. No content on the platform constitutes investment, financial, or trading advice, nor solicitation to buy or sell securities. Research content is general in nature and not tailored to individual Users. MyEquityLab shall not be liable for losses or damages arising from investment or trading decisions based on any information or services provided. MyEquityLab shall not be responsible for delays, errors, interruptions, system failures, data inaccuracies, exchange-feed issues, or failures of internet service providers, User devices, or third-party systems. The User accesses all content, banners, pop-ups, or links at their own risk.

In no event shall MyEquityLab or its directors, employees, or affiliates be liable for any direct, indirect, incidental, special, punitive, exemplary, or consequential damages arising from or connected with the use, performance, or inability to use the Services. This includes loss of data, system issues, procurement of substitute services, transmission errors, or any suspension, interruption, or termination of access. The User acknowledges that their sole remedy is discontinuation of the Service and irrevocably waives any claims for damages of any nature arising out of their use of the website.

These Terms shall be governed by and interpreted in accordance with the laws of India. The courts of Kochi, Kerala, shall have exclusive jurisdiction over any disputes arising from these Terms or the use of the Services. MyEquityLab reserves the right to comply with any governmental, regulatory, or law-enforcement requests relating to the website or User information. These Terms constitute the entire agreement between the User and MyEquityLab and supersede all prior understandings.

Users accessing the Services from outside India do so at their own risk and responsibility. Accessing the platform from jurisdictions where such access is illegal—such as the United States, Canada, or the European Union—is prohibited. Users assume full liability for foreign access and agree to indemnify MyEquityLab for any consequences arising from such use. The Services shall not be construed as solicitation or offering of Services in any jurisdiction where such provision is unlawful.

MyEquityLab may terminate or suspend access without notice if the User violates any provision of these Terms. Users shall remain liable for obligations accrued prior to termination.

All content, including text, videos, software, graphics, photographs, multimedia, coursework, and trademarks (“Content”), is owned by MyEquityLab and protected by IP laws. Content is provided solely for personal, informational, non-commercial use. Streaming is allowed only for real-time viewing. Downloading, copying, reproducing, redistributing, broadcasting, selling, or exploiting any Content, or circumventing security features, is strictly prohibited.

Users agree to online dispute resolution through SEBI’s mechanisms, including the Online Dispute Resolution (ODR) Portal at https://smartodr.in and the SEBI SCORES platform at https://scores.gov.in as mandated by SEBI regulations and circulars.
